June 28, 2019 Opinion or Order Filing 35 ORDER: Presently before the Court are four related actions, each a purported class action relating to data breaches discovered in our about March 2018 in the payment-card databases of Sales Fifth Avenue LLC, Saks & Company LLC, Sales Incorporated and Lord & Taylor, LLC all of which are owned by Hudson's Bay Company. Rudolph v. Hudson's Bay Company, et al., 18 cv 8472 (PKC); Knight, et al. v. Saks Incorporated, 19 cv 4186 (PKC); Harris, et al. v. Lord & Taylor LLC, 19 cv 4199 (PKC); Arkansas Federal Credit Union, et al. v Hudson's Bay, et al.,19 CV 4492 (PKC). The parties to the actions other than Rudolph separately advance what they must view as the modest proposals that there be three rounds of motions to dismiss. Rudolph proposes to barrel ahead with discovery immediately. The proposed plans of action would be an abdication of the Court's case management responsibilities and would turn the goals of Rules 1 and 23, Fed. R. Civ. P., on their head. Having reviewed and considered the proposals, they are rejected as non-starters. The Court is fully aware that the plaintiffs in each of these putative class actions are different and residents of different states with different state law claims. All are against either Hudson's or one of the three units of Hudson's referenced above and assert claims for negligence, negligence per se and breach of an implied contract. Indeed, plaintiffs in the Harris and Knight actions previously wrote to this Court seeking to intervene in the Rudolph action, describing their actions as "aris[ing] out of the same facts involving the same alleged data breach" as Rudolph. (Ltr Mar 19, 2019, at p. 1). They described Rudolph as a "later-filed copycat action." (Id.) The common sense solution is as follows: counsel in the four actions agree upon the filing of a Consolidated Amended Class Action Complaint. In the absence of such agreement, the likely alternative would be for this Court to fashion an appropriate stay in whole or in part of three of the actions with leave to amend granted to the surviving action. Let the parties to the four actions show cause in writing by July 9, 2019 why the four actions ought not be consolidated under the caption "In re Hudson Bay's Company Data Breach Litigation" with leave to file a Consolidated Class Action Complaint or, alternatively, staying overlapping claims in all but one of the four actions.
