Filing 11 STIPULATION AND ORDER. Plaintiffs are qualified trust creditors and beneficiaries under the provisions of the Perishable Agricultural Commodities Act, 7 U.S.C. 499a, et seq. ("PACA"), of Defendants, jointly and severally, for a debt in the aggregate principal amount of $16,899.00, plus accrued interest at the rate of 18% per annum through July 12, 2019 in the amount of $603.74 and reasonable attorneys' fees and legal expenses incurred by Plaintiffs in the amount of $1,620.00 for a total debt under PACA in the amount of $19,542.74 (the "PACA Trust Debt"). For full and final satisfaction of Plaintiffs' claims, subject to the terms and conditions of this Stipulation and Order, Defendants shall pay to Plaintiffs the full amount of the PACA Trust Debt in equal weekly installments of $1,500.00 each commencing on July 12, 2019 and continuing on each successive Friday until the PACA Trust Debt is paid in full. All payments to be made under this Stipulation and Order shall be paid so as to be received on or before 3:00PM on the date due, TIME BEING OF THE ESSENCE. Except as otherwise expressly set forth herein, all payments shall be made by bank check, money order or wire transfer and shall be paid so as to be received by Katzman on or before the date and time payment is due. All payments shall be made payable to "S. Katzman Produce, Inc." and delivered to Plaintiffs at 153-157 New York City Terminal Market, Bronx, New York 10474, and as further set forth in this Stipulation and Order. This case shall be administratively closed, but may be reopened to enforce the terms and conditions of the Stipulation and Order without further costs or fees. This Stipulation and Order constitutes the entire understanding of the Parties and may not be changed unless in a written agreement signed by all parties or their representatives.
