ORDER re: #19 MOTION to Dismiss Complaint. filed by Charter Communications, Inc.. Accordingly, it is hereby ORDERED that Plaintiffs shall file any amended complaint by September 10, 2019. Plaintiffs will not be given any further opportunity to amend the complaint to address issues raised by the motion to dismiss. If Plaintiffs do amend, by three (3) weeks after the amended complaint is filed, Defendant shall: (1) file an answer; (2) file a new motion to dismiss; or (3) file a letter on ECF stating that it relies on the previously filed motion to dismiss. If Defendant files an answer or a new motion to dismiss, the Court will deny the previously filed motion to dismiss as moot. If Defendant files a new motion to dismiss, any opposition shall be filed within fourteen days, and any reply shall be filed within seven days of any opposition. If no amended complaint is filed, Plaintiffs shall file any opposition to the motion to dismiss by September 10, 2019. Defendant's reply, if any, shall be filed by September 10, 2019. At the time any reply is served, the moving party shall supply the Court with one, double sided courtesy hard copy of all motion papers by mailing or delivering them to the Thurgood Marshall United States Courthouse, 40 Centre Street, New York, New York. ORDER: As of this Order, no motion for consolidation has been filed, but the two cases appear to involve common questions of law and fact. Thus, the Court is inclined to consolidate the cases pursuant to Rule 42 of the Federal Rules of Civil Procedure, if not for all purposes then for pretrial purposes. No later than August 16, 2019, the parties shall file letters (or a joint letter) on ECF stating whether they object to such consolidation and raising any other issues that might be pertinent to consolidation, coordination, and the efficient resolution of these cases going forward. Additionally, at the initial pretrial conferences in these matters, which are both scheduled for October 3, 2019, at 3:00 p.m., the parties should be prepared to discuss whether Plaintiffs in the two cases should file a single, consolidated amended complaint.
