Because this notice of dismissal is being filed before service by defendants of either an answer or a motion for summary judgment, Plaintiff's dismissal of the Action is effective upon filing of this notice. Plaintiff requests that this Court retain continuing jurisdiction for purposes of reviewing a mootness fee application, if any, which may be filed under this case number.
