Filing 4 ORDER OF DISMISSAL: The Clerk is directed to assign this matter to my docket, mail a copy of this order to Plaintiff, and note service on the docket. The Court dismisses Plaintiff's claims against Justice Green and L. Lewis of the New York State Public Service Commission as frivolous and because the claims seek monetary relief against defendants who are immune from such relief. 28 U.S.C. 1915(e)(2)(B)(i), (iii). The Court dismisses Plaintiffs challenge to the state court judgment for a lack of subject matter jurisdiction, Fed. R. Civ. P. 12(h)(3), and dismisses the remaining allegations for failure to state a claim on which relief may be granted, 1915(e)(2)(B)(ii). The Court declines, under 28 U.S.C. 1367(c), to exercise its supplemental jurisdiction over any state-law claims Plaintiff may be asserting The Court certifies, pursuant to 28 U.S.C. 1915(a)(3), that any appeal from this order would not be taken in good faith, and therefore in forma pauperis status is denied for the purpose of an appeal. See Coppedge v. United States, 369 U.S. 438, 444-45 (1962). (Signed by Judge Colleen McMahon on 10/7/2019) (rdz) Transmission to Docket Assistant Clerk for processing. |
