Filing 4 CIVIL JUDGMENT: IT IS ORDERED, ADJUDGED, AND DECREED that under the January 21, 1994 order in Sadler v. Dep't of Justice, No. 94-CV-337 (TPG) (S.D.N.Y. Jan. 22, 1994), the complaint is dismissed without prejudice. The Court certifies under 28 U.S.C. 1915(a)(3) that any appeal from the Court's judgment would not be taken in good faith. IT IS FURTHER ORDERED that the Clerk of Court mail a copy of this judgment to Plaintiff and note service on the docket. (Signed by Judge Colleen McMahon on 8/29/2019) (sac) Transmission to Docket Assistant Clerk for processing. |
Filing 3 ORDER OF DISMISSAL UNDER 28 U.S.C. 1651: On January 21, 1994, the Court imposed a prefiling injunction, requiring Plaintiff to obtain leave of Court before filing any new action in this Court. See Sadler v. Dep't of Justice, No. 94-CV-337 (TPG) (S.D.N.Y. Jan. 22, 1994). Plaintiff has not sought leave from the Court to file this action, and the Court therefore dismisses it without prejudice for Plaintiff's failure to comply with the January 21, 1994 order. The Clerk of Court is directed to assign this matter to my docket, mail a copy of this order to Plaintiff, and note service on the docket. The Court certifies, pursuant to 28 U.S.C. 1915(a)(3), that any appeal from this order would not be taken in good faith and therefore in forma pauperis status is denied for the purpose of an appeal. See Coppedge v. United States, 369 U.S. 438, 444-45 (1962). (Signed by Judge Colleen McMahon on 8/29/2019) (sac) Transmission to Docket Assistant Clerk for processing. Modified on 8/29/2019 (sac). |
