A case management conference was held on January 31, 2022 whereby the Court reluctantly extended discovery for the sole purpose of deposing the five individuals identified by Plaintiff: Mr. Robert De Niro, Mr. Michael Kaplan, Mr. Michael Tasch, Tom Harvey, and Tiffany Chen. With regard to Plaintiff's motion to compel documents that are being withheld on a claim of privilege, the Court first directs the parties to the Court's Order, issued on January 20, 2022, which contrary to Plaintiff's representations made today during the case management conference, does not suggest that the "Defendants present documents from each category at issue." (Case Mgmt. Conf. Transcript Jan. 31, 2022 at 15:06-15:26.) (ECF No. 142.) The language suggesting different 'categories' is absent from the Order and clearly states that the parties are to provide 25 sample documents to the Court. For further clarification please refer to that Order before said documents are presented for in camera review. In light of the outstanding discovery and its impact on upcoming depositions, the Court will extend fact discovery for the sole purpose of deposing the individuals listed above for 30 days after Court's ruling on the parties' motion to compel documents withheld on a basis of privilege/improper redactions. All other discovery must be completed by February 11, 2022. Defendants are ordered to produce a computation of damages by February 7, 2022. The submission shall be accompanied by a letter motion to compel (no more than 4 pages). By December 24, 2021, Plaintiff shall submit a letter brief of no more than 4 pages setting forth her response. March 16, 2020 Opinion or Order Filing 21 ORDER: NOW, THEREFORE, in order to protect public health, reduce unnecessary travel, and minimize the risk of exposure while promoting the "just, speedy, and inexpensive determination of every action and proceeding," Fed. R. Civ. P. 1; It is hereby ORDERED, pursuant to Fed. R. Civ. P. 30(b)(3) and (b)(4), that all depositions in this action may be taken via telephone, video conference, or other remote means, and may be recorded by any reliable audio or audiovisual means. This order does not dispense with the requirements set forth in Fed. R. Civ. P. 30(b)(5), including the requirement that ("[u]nless the parties stipulate otherwise") the deposition be "conducted before an officer appointed or designated under Rule 28," and that the deponent be placed under oath by that officer. In light of the current pandemic, the court reporter may attend the deposition and administer the oath via the same remote means (e.g., telephone conference call or video conference) used to connect all other remote participants, and so long as all participants (including the officer) can clearly hear and be heard by all other participants. It is further ORDERED, pursuant to Fed. R. Civ. P. 16(b)(4), that all unexpired deadlines for the completion of fact depositions, fact discovery, expert depositions, expert discovery, and/or all discovery are hereby EXTENDED for a period of 60 days, together with all post discovery deadlines previously set by this Court. Nothing in this Order prevents the parties from seeking to further modify the pretrial schedule in this action in light of the COVID-19 pandemic (or for any other good cause). Prior to seeking such relief, the parties must, as always, meet and confer (via remote means) in a good faith effort to reach agreement on how best to fulfil the goals of Rule 1 while avoiding unnecessary health risks. January 30, 2020 Opinion or Order Filing 16 SCHEDULING ORDER: On January 30, 2020, the parties appeared for an Initial Case Management Conference. After review of the pleadings and consultation with the parties, the following Scheduling Order is entered pursuant to Rule 16 of the Federal Rules of Civil Procedure: Pleadings and Parties. The parties may amend the pleadings or join additional parties until April 30, 2020. Discovery. All fact discovery shall be completed by October 29, 2020. All expert discovery shall be completed by January 21, 2021. Interim Discovery Deadlines. The parties shall exchange initial disclosures by no later than February 13, 2020. The parties shall produce initial sets of relevant documents identified and shall serve initial document requests by no later than March 5, 2020. The parties will exchange initial sets of interrogatories by no later than March 12, 2020. Responses thereto shall be due on April 13, 2020. Requests for admission shall be served by September 24, 2020. Responses thereto shall be due on October 26, 2020. Any final document requests and/or interrogatories shall be served by no later than September 30, 2020. All depositions shall be completed by October 29, 2020. Interim deadlines may be adjusted by the parties without further order of the Court. Status Conference. The parties are excused from the mediation process. Rule 1 and Rule 26(b)(1). Counsel shall comply with Rule 1 and Rule 26(b)(1) in the conduct of discovery. Document Requests. Counsel shall be fully familiar with their obligations under Rules 34 and 26(g) and consider and discuss ways to ensure compliance and minimize disputes regarding overbreadth and specificity of requests and responses. A failure to comply with this responsibility carries serious consequences. Requests for "any and all" documents on a broad topic are presumptively improper. Likewise, courts have held that an objection that does not appropriately explain its grounds is forfeited. See, e.g., Wesley Corp. v. Zoom T.V. Prods., LLC, No. 17-100212018, 2018 WL 372700, at *4 (E.D. Mich. Jan. 11, 2018); Fischer v. Forrest, No. 14 Civ. 01304, 2017 WL 773694 (S.D.N.Y. Feb. 28, 2017) ("[A]ny discovery response that does not comply with Rule 34's requirement to state objections with specificity (and to clearly indicate whether responsive material is being withheld on the basis of objection) will be deemed a waiver of all objections (except as to privilege).).
