November 6, 2019 Opinion or Order Filing 10 ORDER TO SHOW CAUSE: An initial conference was scheduled in the above captioned case for November 1, 2019, at 11:00 am. In a phone conference on October 24, 2019, the Court expressly directed plaintiff's counsel, Richard M. Garbarini, Esq., to appear at the initial conference. Despite this, plaintiff's counsel did not appear. Instead, plaintiff's counsel submitted a Notice of Voluntary Dismissal, ECF No. 8. The Notice of Voluntary Dismissal, however, contained a totally incorrect caption and so was of no effect. Id. Accordingly, after plaintiff's counsel failed to appear at the in-court conference, the Court, telephoning from the bench, left plaintiff's counsel a voicemail message asking him to correct the Notice of Voluntary Dismissal caption by 5:00 pm that same day. Counsel failed to do so. On November 4, 2019, the Court left plaintiff's counsel another message requesting he call the Court by the end of that day. Counsel again failed to respond. Given these defalcations, plaintiff's counsel is here ordered to submit a sworn affidavit by November 12, 2019, showing cause why sanctions should not be imposed for his seeming contempt of court.
