Filing 6 CIVIL JUDGMENT. IT IS ORDERED, ADJUDGED AND DECREED that the petition is dismissed without prejudice for Petitioner's failure to submit a completed request to proceed in forma pauperis ("IFP application") or pay the $5.00 filing fee. See 28 U.S.C. 1914, 1915. The Court certifies under 28 U.S.C. 1915(a)(3) that any appeal from the Court's judgment would not be taken in good faith. IT IS FURTHER ORDERED that the Clerk of Court mail a copy of this judgment to Plaintiff and note service on the docket. SO ORDERED. (Signed by Judge Colleen McMahon on 12/2/2019) (rjm) Transmission to Docket Assistant Clerk for processing. |
Filing 5 ORDER OF DISMISSAL. By order dated October 29, 2019, the Court directed Petitioner, within thirty days, to submit a completed request to proceed in forma pauperis ("IFP application") or pay the $5.00 fee required to file a writ of habeas corpus in this Court. That order specified that failure to comply would result in dismissal of the petition. Petitioner has not filed an IFP application or paid the fee. Accordingly, the petition is dismissed without prejudice. See 28 U.S.C. 1914, 1915. The Clerk of Court is directed to mail a copy of this order to Petitioner and note service on the docket. The Court certifies under 28 U.S.C. 1915(a)(3) that any appeal from this order would not be taken in good faith, and therefore IFP status is denied for the purpose of an appeal. Cf. Coppedge v. United States, 369 U.S. 438, 444-45 (1962) (holding that an appellant demonstrates good faith when he seeks review of a nonfrivolous issue). SO ORDERED. (Signed by Judge Colleen McMahon on 12/2/2019) (rjm) Transmission to Docket Assistant Clerk for processing. |

Filing 1 ORDER: The Clerk of Court is directed to assign this matter to my docket, mail a copy of this order to Petitioner, and note service on the docket. The Court directs the Clerk of Court to sever the claims of Petitioners Nata Bob and Yusuf Raheem and open each as a new civil action under 28 U.S.C. 2241. Petitioner Kenneth Thomas's claims will proceed in the action under docket number 19-CV-8226 (CM). The Clerk of Court is directed to docket this as a "written opinion" within the meaning of Section 205(a)(5) of the E-Government Act of 2002. Nata S. Bob and Yusuf Raheem terminated.
