SO-ORDERED STIPULATION FOR MODIFICATION OF ORDER OF PROTECTION. IT IS HEREBY STIPULATED AND AGREED, by and among the undersigned that the TOP shall be modified as follows: 1. Petitioner Jacquety shall have interim daily Facetime access with the parties' child after school between 6:00 p.m. EST-6:30 p.m. EST for up to twenty minutes each time. Petitioner Jacquety shall have interim weekend Facetime access with the parties' child on Saturdays and Sundays between 6:00 p.m. EST - 6:30 p.m. EST for up to twenty minutes each time. 2. The Respondent Tena Baptista shall facilitate said interim daily Facetime with the parties' child by placing a call to Petitioner Jacquety's designated cellular telephone line, to wit: +212663434759. 3. Both parties shall observe the Child's Bill of Rights during the calls, a copy of which is annexed hereto and made a part hereof as if restated in full. Both parties are permitted to record the daily Facetime access. The Respondent Tena Baptista may be present for the daily Facetime access but shall not participate in any way. Either party may terminate a call if there is a violation of the Child's Bill of Rights during the calls. 4. This stipulation is without prejudice to either party, subject to the jurisdiction of a particular court, raising any and all claims as to issues relating to custody, future parenting time or supervised parenting time or the appropriateness of the TOP in any form, at the December 10, 2019 court appearance in New York County Family Court, or at any other time during the pendency of the proceeding in Family Court including the trial of the Family Offense petition case, or in the United States District Court, including without limitation the negotiation of a stipulation to further modify the ex parte order which was obtained to allow for in person supervised access to the Child when Petitioner Jacquety is here pending the hearing of the Family Offense petition, and/or Hague Convention case in SDNY. 5. Facsimile or email signatures shall be deemed original for purposes of this Stipulation and Agreement, and this Stipulation may be executed in counterparts. So ordered.
