Filing 9 ORDER: This case was removed to this Court from New York supreme court on June 25, 2020. A copy of the Notice of Initial Pretrial Conference was mailed to Plaintiff on July 1, 2020 (Minute Entry for July 1, 2020), and a copy of the Court's most recent Order was mailed to Plaintiff on July 7, 2020 (Minute Entry for July 7, 2020). Nevertheless, Plaintiff has failed to appear or take any other action up to this point. Accordingly, the Court ORDERS Plaintiff to show cause in writing on or before September 8, 2020, why this case should not dismissed for failure to prosecute. The Court ORDERS Defendant to serve a copy of this Order on Plaintiff on or before July 31, 2020, and to file proof of service on or before August 5, 2020. SO ORDERED. Filing 7 MEMO ENDORSEMENT denying without prejudice #5 Motion to Dismiss. ENDORSEMENT: The Court is in receipt of a motion to dismiss pursuant to Federal Rule of Civil Procedure 12(b)(5), filed by Defendant. (Dkt. #5). That motion is DENIED without prejudice as to renewal for two reasons. First, in accordance with Rule 4(A) of the Court's Individual Rules of Practice, parties are required to file a letter seeking a pre-motion conference before filing any motions to dismiss. Defendant has not complied with this rule. Second, Plaintiff has yet to appear in this removed case, and therefore is currently unable to respond to any motion practice. The Court will not accept any motion to dismiss while Plaintiff has not yet appeared. However, once Plaintiff does appear in this action, Defendant is welcome to renew its motion in compliance with this Court's Rule 4(A). (Signed by Judge Katherine Polk Failla on 7/6/2020) (rro) |
