ENDORSEMENT: The Court is in receipt of a motion to dismiss pursuant to Federal Rule of Civil Procedure 12(b)(5), filed by Defendant. (Dkt. #5). That motion is DENIED without prejudice as to renewal for two reasons. First, in accordance with Rule 4(A) of the Court's Individual Rules of Practice, parties are required to file a letter seeking a pre-motion conference before filing any motions to dismiss. Defendant has not complied with this rule. Second, Plaintiff has yet to appear in this removed case, and therefore is currently unable to respond to any motion practice. The Court will not accept any motion to dismiss while Plaintiff has not yet appeared.
