September 17, 2020 Opinion or Order Filing 15 ORDER OF DISMISSAL: The Court having been advised that all claims asserted herein have been settled in principle, ECF No. 14, it is ORDERED that the above entitled action be and is hereby dismissed and discontinued without costs, and without prejudi ce to the right to reopen the action within sixty days of the date of this Order if the settlement is not consummated. Any application to reopen must be filed within sixty days of this Order; any application to reopen filed thereafter may be denied s olely on that basis. Further, if the parties wish for the Court to retain jurisdiction for the purposes of enforcing any settlement agreement, they must submit the settlement agreement to the Court within the same sixty-day period to be so-ordered by the Court. Per Rule IV(C) of the Courts Individual Practices in Civil Cases, the Court will not retain jurisdiction to enforce a settlement agreement unless it is made part of the public record. July 27, 2020 Opinion or Order Filing 7 ORDER: To protect the public health, while promoting the "just, speedy, and inexpensive determination of eve1y action and proceeding," Fed. R. Civ. P. 1, it is ORDERED pursuant to Rules 30(b)(3) and 30(b)(4) of the Federal Rules of Civil P rocedure that all depositions in this action may be taken via telephone, videoconference, or other remote means. It is further ORDERED pursuant to Rule 30(b)(5) that a deposition will be deemed to have taken place "before an officer appointed or designated under Rule 28" if such officer attends the deposition using the same remote means used to connect all other participants, so long as all participants (including the officer) can clearly hear and be heard by all other participants.
