August 18, 2020 Opinion or Order Filing 10 ORDER: Under Rule 15(a)(1)(B), a plaintiff has 21 days after the service of a motion under Rule 12(b) to amend the complaint once as a matter of course. Accordingly, it is hereby ORDERED that plaintiff shall file any amended complaint by September 8, 2020. No further opportunities to amend will ordinarily be granted. If plaintiff chooses not to file an amended complaint, plaintiff shall file an opposition to UPS's motion to dismiss by September 8, 2020. UPS's reply, if any, shall be filed by September 15, 2020. If plaintiff does amend the complaint, UPS shall thereafter have 21 days, until September 15, 2020, to: (1) file an answer; (2) file a new motion to dismiss; or (3) submit a letter to the Court, copying all parties, stating that it relies on the previously filed motion to dismiss.
