STIPULATION AGREEING TO STAY ACTION: IT IS HEREBY AGREED AND PROPOSED BETWEEN ALL PARTIES, SUBJECT TO COURT APPROVAL: The parties propose this action be stayed for a period of not more than 180 days "the Stay"). The Stay shall terminate upon the earlier of: (1) 180 days from the date this agreed proposed order is approved by the Court; or (2) upon notice to the Court from Plaintiff that a voluntary settlement of all claims under this action has not been reached. Upon termination of the Stay without a voluntary settlement, the case shall be referred to Arbitration consistent and in compliance with the CBA's No-Discrimination Protocol and an additional Stay shall commence for a period of 180 days until the conclusion of the Arbitration. Should the matter be referred to arbitration as stated herein, Employer Defendants agree to waive any defense in the arbitration based upon any alleged failure by Plaintiff to comply with procedures or timelines contained in the CBA's no discrimination protocol and further set forth in this Order.
