Motions due by 3/26/2021. Fact Discovery due by 6/24/2021. This case is to be tried to a jury. Counsel for the parties have conferred, and the present best estimate of the length of trial is 5 days. Pretrial Conference set for 6/30/2021 at 04:00 PM before Judge Jesse M. Furman. Upon review of the parties' joint letter at ECF No. 24, the Court concludes that an initial pretrial conference is not necessary. Thus, the conference currently scheduled for February 24, 2021, is hereby CANCELLED. If either party believes that a conference is actually warranted, the parties should confer and file a letter motion to that effect. The parties should note the deadlines on the previous page. No later than February 25, 2021, the parties shall file an agreed upon order with respect to the conditional certification of the collective action for the Court to "so order." SO ORDERED. February 16, 2021 Opinion or Order Filing 23 ORDER. In light of the COVID-19 situation, the Court will not hold the upcoming conference in this case in person. Counsel should submit their proposed case management plan and joint letter by the Thursday prior to the conference, as directed in the Court's earlier Scheduling Order. In their joint letter, the parties should also indicate whether they can do without a conference altogether. If so, the Court may enter a case management plan and scheduling order and the parties need not appear. If not, the Court will hold the initial conference by telephone, albeit perhaps at a different time. To that end, counsel should indicate in their joint letter dates and times during the week of the conference that they would be available for a telephone conference. In either case, counsel should review and comply with the Court's Emergency Individual Rules and Practices in Light of COVID-19, available at https://nysd.uscourts.gov/hon-jesse-m-furman. SO ORDERED. (Signed by Judge Jesse M. Furman on 2/16/21) (yv)
February 5, 2021 Opinion or Order Filing 22 ORDER granting in part and denying in part #21 Letter Motion for Leave to File Document. Plaintiff's motion, ECF No. 21, is granted in part and denied in part. The parties are relieved from their obligations to participate in early mediation. But the Court will not set a motion deadline at this time. Instead, the parties are instructed to confer and, in accordance with the Court's instructions as laid out at ECF No. 7, file a letter no later than the Thursday before the initial pretrial conference indicating -- among other things -- whether Defendants would be willing to consent to preliminary certification so as to obviate motion practice on this issue. The Court will set a motion deadline, if needed, thereafter. The Clerk of Court is directed to terminated ECF No. 21. (Signed by Judge Jesse M. Furman on 2/5/2021) (cf)
