November 23, 2020 Opinion or Order Filing 5 ORDER OF DISMISSAL: The Clerk of Court is directed to mail a copy of this order to Plaintiff and note service on the docket. The Court dismisses the complaint for failure to state a claim, but grants Plaintiff leave to replead his claims within sixty days. The Court declines to exercise supplemental jurisdiction over any state-law claims Plaintiff may be asserting. See 28 U.S.C. 1367(c)(3). Plaintiff must submit any second amended complaint to this Court's Pro Se Intake Unit within sixty days of the date of this Memorandum Opinion and Order, caption the document as a "Second Amended Complaint," and label the document with docket number 20-CV-9643 (JMF). A Second Amended Complaint for Employment Discrimination form is attached to this order. No summons will issue at this time. If Plaintiff fails to file a second amended complaint within the time allowed, and he cannot show good cause to excuse such failure, the Court will direct the Clerk of Court to enter judgment in accordance with this Order and close this action without further notice. In light of the current global health crisis, parties proceeding pro se are encouraged to submit all filings by email to Temporary_Pro_Se_Filing@nysd.uscourts.gov. Pro se parties also are encouraged to consent to receive all court documents electronically. A consent to electronic service form is available on the Court's website. Pro se parties who are unable to use email may submit documents by regular mail or in person at the drop box located at the U.S. Courthouses in Manhattan (500 Pearl Street) and White Plains (300 Quarropas Street). For more information, including instructions on this new email service for pro se parties, please visit the Court's website at nysd.uscourts.gov. The Court certifies under 28 U.S.C. 1915(a)(3) that any appeal from this order would not be taken in good faith, and therefore in forma pauperis status is denied for the purpose of an appeal.
