Filing 16 STIPULATION OF SETTLEMENT AND ORDER OF DISMISSAL WITH PREJUDICE PURSUANT TO RULE 41(a)(1)(A)(ii): NOW, THEREFORE, IT IS HEREBY STIPULATED AND AGREED, by and between the Parties, through the undersigned, as follows: In consideration of payment of the sum set forth in paragraph "2" below, this action is hereby dismissed with prejudice to Rule 41(a)(1)(A)(ii), without fees, costs, or expenses in excess of the amount specified in paragraph "2". The City of New York shall pay TWENTY-SIX THOUSAND DOLLARS AND ZERO CENTS ($26,000.00) in full satisfaction of all claims for attorney's fees, costs, and expenses, incurred or accrued in connections with N.S.'s 2018-2019 and 2019-2020 school years, including Impartial Hearing Case No. 185458 and the instant federal action. Filing 5 NOTICE OF INITIAL PRETRIAL CONFERENCE FOR CASES FILED UNDER 20 U.S.C. 1415(i)(3): Counsel for all parties are directed to appear before the undersigned for an Initial Pretrial Conference ("IPTC") in accordance with Rule 16 of the Federal Rules of Civil Procedure on April 2, 2021 at 10:00 a.m. in Courtroom 443 of the Thurgood Marshall Courthouse, 40 Foley Square, New York, New York, 10007. No later than March 12, 2021, the parties must submit a joint letter stating whether the initial pre-trial conference would be helpful in expeditiously managing this case or whether, in the alternative, they would prefer that the Court forgo the IPTC and set a schedule for briefing a motion by Plaintiff for summary judgment after Defendant has answered. If theparties would prefer to forgo an IPTC and set a summary-judgment briefing schedule, they must propose such a schedule in their letter. The parties' letter must also state whether they jointly believe that participation in the free, court-annexed mediation program or a referral to the assigned Magistrate Judge for settlement discussions would be beneficial to reaching a mediatedresolution of this matter. Plaintiffs are encouraged to serve defendants promptly. The parties must append to their joint preconference letter a jointly proposed Civil Case Management Plan and Scheduling Order. Plaintiff's counsel, or Defendant's counsel in removed cases, is responsible for distributing copies of this Notice to all parties. And as set forth herein. SO ORDERED.
