STIPULATION AND ORDER OF SUBSTITUTION, DISMISSAL, AND LEAVE TO FILE AN AMENDED COMPLAINT, NOW, THEREFORE, IT IS HEREBY STIPULATED AND AGREED, by and between parties and their counsel, that: 1. The United States of America is substituted as defendant in place of the Federal Defendants in the State Court Action; 2. The Federal Defendants are hereby dismissed from the State Court Action with prejudice and without costs or attorneys' fees; 3. Pursuant to Fed. R. Civ. P. 41(a)(1)(A)(ii), Plaintiffs voluntarily dismiss the claims in the State Court Action against the United States of America, Joy L. Tun, M.D., Sarah Watler, M.D., Montefiore Health System, Inc., and Montefiore Medical Center (collectively, the "Remaining Defendants"), without prejudice and without costs or attorneys' fees; 4. The Clerk of Court is respectfully directed to close the State Court Action, No. 21 Civ. 482. 5. Defendants Joy L. Tun, M.D., Sarah Watler, M.D., Montefiore Health System, Inc., and Montefiore Medical Center consent to the jurisdiction of this Court and agree to be added as defendants to the Federal Action. 6. Within 30 days of this stipulation, Plaintiffs shall file in the Federal Action a single, consolidated amended complaint against the Remaining Defendants. The Remaining Defendants shall answer the consolidated amended complaint within 30 days of service. 7. This stipulation may be signed in counterparts, each of which constitutes an original and all of which constitute one and the same stipulation. Facsimiles and/or PDFs of signatures shall have the same force and effect as original signatures and constitute acceptable, binding signatures for purposes of the stipulation. SO ORDERED.
