Filing 14 ORDER: Plaintiff's request to withdraw his 1983 claim is GRANTED. However, if Plaintiff amends this action to bring a defamation claim instead, this Court would likely have no jurisdiction over the action. Defamation arises under state law and the Court would be without a federal cause of action that could provide a basis for supplemental jurisdiction over any defamation claim. Cf. Briarpatch Ltd., L.P. v. Phoenix Pictures, Inc., 373 F.3d 296, 308 (2d Cir. 2004) (Courts have supplemental jurisdiction over state law claims when they are so related to a federal question that they form part of the same case or controversy). Thus, given Plaintiff's desire to withdraw his sole 1983 claim, Plaintiff has two options. He may: Voluntarily dismiss this case in its entirety, without prejudice to file a defamation suit in state court if he chooses; or Show cause in writing, by no later than February 26, 2021, as to why his proposed amended complaint would not be futile because the Court would lack jurisdiction over it. If he does so, Defendants may reply to his submission by March 3, 2021 by 5:00 pm. If Plaintiff does not voluntarily dismiss this case, the conference currently scheduled for March 4 will remain on the calendar to discuss the parties' submissions. Finally, given Plaintiff's withdrawal of the 1983 claim, Defendants' anticipated motion to dismiss (currently due March 1, 2021) is now moot. In the event another complaint is filed in this case, Defendants may renew their request to file a motion to dismiss according to this Court's individual practices.
