March 24, 2021 Opinion or Order Filing 26 ORDER: By Order of Reference dated March 4, 2021 (Dkt. No. 10), Judge Furman referred this case to me for settlement. The parties and the Court conferred, and agreed that the conference will be held before me on April 13, 2021 at 2:30 p.m. by telephone. Using the conference line system, the Court will begin the settlement conference in joint session with all parties on the line before breaking into private session and speaking to the parties individually, as the technology the Court is using should be able to facilitate breakout sessions with each side. March 22, 2021 Opinion or Order Filing 22 ORDER re: (11 in 1:21-cv-01006-JMF) Order. On March 19, 2021, a letter from Plaintiff Larry Anderson, dated March 11, 2021, was entered on the docket. ECF Nos. 20, 21.1 The letter raises the question of whether Mr. Anderson should be granted leave to amend his complaint to allege a different amount of damages. Per the Courts Orders of March 4, 2021 and March 5, 2021, ECF Nos. 11, 14, however, the Court believes that the parties should be devoting their attention and resources to settlement at this time. Any settlement-related matters should be raised with Magistrate Judge Cott in communications addressed to him. If good-faith efforts at settlement fail, the parties should address the question of whether Mr. Anderson should be permitted leave to amend in their next-steps letter due 90 days from the date of the Courts March 4 order, ECF No. 11 that is, June 2, 2021. March 5, 2021 Opinion or Order Filing 14 ORDER denying without prejudice #8 Motion for Compensation. Yesterday after the Court had signed orders adopting New GM's proposal to refer the parties to Magistrate Judge Cott for mediation, but before the orders were docketed ECF Nos. 10, 11 the Court received two letters from Plaintiff Larry Anderson describing the factual background underlying his claims as well as a motion that appears to request an entry of judgment against Defendants. See ECF Nos. 7, 8, 9. Mr. Andersons motion is DENIED as premature, without prejudice to renewal at the appropriate time. Per the Courts Order of March 4, 2021, ECF No. 11, in the first instance, the parties shall attempt to resolve this matter amicably with the assistance of Magistrate Judge Cott. If such efforts prove unsuccessful, the parties shall confer and file a joint letter proposing next steps, including a proposed briefing schedule for any motions the parties intend to make. March 5, 2021 Opinion or Order Filing 13 ORDER: By Order of Reference dated March 4, 2021 (Dkt. No. 10), Judge Furman referred this case to me for settlement. The parties are directed to advise the Court by March 11 when they wish to schedule the settlement conference. The parties should do so by filing a letter-motion on the docket that indicates at least three dates that are mutually convenient for the parties. Alternatively, counsel are free to e-mail my deputy clerk, David Tam, at David_Tam@nysd.uscourts.gov to find a mutually convenient date for the parties and the Court. In light of the COVID-19 pandemic, any settlement conference in the foreseeable future will likely be conducted telephonically. Using the Court's conference line system, the Court will begin the settlement conference in joint session with all parties on the line before breaking into private session and speaking to the parties individually, as the technology the Court is using can facilitate breakout sessions with each side. If the parties wish to provide a different platform for the settlement conference (such as Zoom, Skype, or the equivalent) and not simply proceed telephonically they may so advise the Court and the Court will then schedule a conference to discuss logistics. February 10, 2021 Opinion or Order Filing 4 ORDER. Although Plaintiff does not name it as such, the Complaint appears to allege wrongdoing by General Motors LLC ("New GM"). The Clerk of Court is therefore directed, under Rule 21 of the Federal Rules of Civil Procedure, to amend the caption of 21-CV-1006 to add General Motors LLC as a defendant. This amendment is without prejudice to any defenses that New GM may wish to assert. New GM is hereby ORDERED to confer with Plaintiff (and, if appropriate Lead Counsel) to discuss how to proceed with resolving Plaintiff's claims and, no later than March 3, 2021, the parties shall file a joint letter proposing next steps. The Court requests that New GM waive service of process in 21-CV-1006. The Clerk of Court is directed to mail a copy of this order to Plaintiff, together with an information package. SO ORDERED.
