Defendants will make a final claim determination within 60 days of the appeal. IT IS FURTHER STIPULATED AND AGREED, that this stipulation is without prejudice and shall not bar the plaintiff from reinstituting a lawsuit or other legal action once a final claim determination has been made in accordance with this stipulation. IT IS FURTHER AGREED, that this stipulation may be signed in counterparts, that electronic and/or facsimile signatures will be treated as original signatures. IT IS FURTHER AGREED, that this stipulation may be filed with the Clerk of the Court without further notice. This matter is hereby dismissed without prejudice.
