STIPULATION OF DISMISSAL WITHOUT PREJUDICE: IT IS HEREBY STIPULATED AND AGREED by the undersigned attorneys for the parties to this action, that whereas no party is an infant or incompetent for whom a committee has been appointed, that the above-entitled action be, and is hereby, dismissed without prejudice as to all defendants. IT IS FURTHER STIPULATED AND AGREED, that upon execution of this stipulation of dismissal, plaintiff will submit an administrative appeal within 60 days. Defendants will make a final claim determination within 60 days of the appeal. IT IS FURTHER STIPULATED AND AGREED, that this stipulation is without prejudice and shall not bar the plaintiff from reinstituting a lawsuit or other legal action once a final claim determination has been made in accordance with this stipulation. IT IS FURTHER AGREED, that this stipulation may be signed in counterparts, that electronic and/or facsimile signatures will be treated as original signatures. IT IS FURTHER AGREED, that this stipulation may be filed with the Clerk of the Court without further notice. This matter is hereby dismissed without prejudice.
