In re-reviewing your initial applications for appointment as lead plaintiff and class counsel, we noted the following. First, according to your disclosures, it appears that the Peace Officers' Annuity and Benefit Fund of Georgia ("Peace Officers") purchased all of their holdings in American Depositary Receipts of Credit Suisse Group AG (the "ADRs") in March 2021, i.e., near the end of the class period. ECF No. 18-2. Though Sheet Metal Workers Pension Plan of Northern California ("Sheet Metal") purchased ADRs during March 2021 as well, Sheet Metal also purchased ADRs between December 2020 and February 2021. ECF No. 23-3. Second, according to the operative complaint and the movants' own submissions, some of the March 2021 purchases were made after the disclosure of some of the conduct challenged in the complaint. An issue thus arises as to whether one or both of the proposed lead plaintiffs would be subject to challenge during the class certification process. See, e.g., In re Hebron Tech. Co., Ltd. Sec. Litig., No. 20 Civ. 4420, 2020 WL 5548856, at *7 (S.D.N.Y. Sept. 16, 2020). Under the usual scenario where parties compete to be lead plaintiff, issues like this would be raised by the competing litigants rather than the Court. While that paradigm is clearly preferable, not addressing this issue before selection of lead plaintiff and class counsel is not an option. If you wish to supplement your earlier submissions, the Court will consider any additional briefing. We are proceeding on the assumption that the movants have provided their full trading records for the class period to the Court.
