LETTER from John Floyd, III dated 6/9/2021 re: This letter is written in regards to the above mentioned civil case. Today I received the updated docket Log Sheet in case Floyd vs. Filipowski et al., on the front page it shows that the case is unassigned to a Judge at the moment, and the cause of the suit is; 42:1983 Prisoner Civil Rights. On the opposite side of the page where it states Nature of Suit, it shows; 555 Prisoner: Prison Condition. I am confused as to what that means, as well how does the court determine the nature of suit. If possible I would like to gain some insight and clarification as to what that means and how it was established. My reasoning for such inquisition is because I was informed that before a 1983 suit can be brought into court the plaintiff must exhaust all administrative remedies...I am asking that the court send me a Pro Se litigation manual, so I can properly serve the defendants. ORDER GRANTING IFP APPLICATION IN PRISONER CASE: The Clerk of Court is directed to send a copy of this order and the prisoner authorization to the agency having custody of Plaintiff. That agency is directed to forward copies of Plaintiff's prison trust fund account for the past six months and to disburse the payments required under 28 U.S.C. 1915 to the United States District Court for the Southern District of New York and to include the above docket number on the disbursement before sending it to the Court. If Plaintiff is transferred to another facility, the current facility shall provide a copy of this order to the facility to which Plaintiff is transferred. The Clerk of Court is also directed to send a copy of this order to Plaintiff and note service on the docket. Finally, it is Plaintiff's obligation to promptly submit a written notification to the Court if Plaintiff's address changes, and the Court may dismiss the action if Plaintiff fails to do so.
