STIPULATION TO CONSOLIDATE: IT IS HEREBY STIPULATED AND AGREED, by and between the undersigned attorneys of record for the parties to the above-entitled action, that this case shall be consolidated with the civil case pending in this court titled MOUSSA GUEYE v. RYDER TRUCK RENTAL LT, RYDER TRUCK RENTAL, INC. and DAVID VELA, Civil Case Number 1 :2 l-CV-05062 (MKV)(SN). Consolidation of the cases pursuant to Fed. R. Civ. P. 42(a) is appropriate because the cases to be consolidated present common questions of fact and law, consolidation will result in substantial savings of the resources of the court and the parties, and no party will be prejudiced by consolidation. IT IS FURTHER STIPULATED AND AGREED that, as Defendants Ryder Truck Rental LT and Ryder Truck Rental, Inc. were discontinued from the state court action before it was removed to the Southern District of New York, these defendants are severed from the remaining action and are hereby deleted from the caption.
