July 20, 2021 Opinion or Order Filing 15 ORDER: denying #14 Letter Motion to Expedite. Petitioner's request to expedite the briefing schedule in this matter is DENIED. Although the Court has not made a final determination, from a review of the relevant case law, it appears that Petitioner likely lacks standing to bring his Petition. To allege standing, Petitioner must show that the alleged injury is actual or imminent and is not conjectural or hypothetical. See Lujan v. Defs. of Wildlife, 504 U.S. 555, 560-61 (1992). It appears that pursuant to the provision of the First Step Act on which Petitioner is relying, he is not yet entitled to earned credits. Without such an entitlement, he cannot allege any actual or imminent injury. See, e.g., Distefano v. Pliler, 21-CV-773, Dkt. No. 14 at 3-4 (July 5, 2021) (collecting cases holding that the First Step Act does not require the award of time credits earned until January 15, 2022). Accordingly, the Court lacks good cause to expedite the briefing schedule. The Government's response is due no later than Friday, August 13, 2021 and Petitioner's reply in support of his Petition is due no later than Friday, September 17, 2021. See Order, Dkt. 5. The Court notes that Petitioner is welcome to file his reply brief earlier than the deadline. The Clerk of Court is respectfully directed to close the open motions at docket entries 7 and 14.
