ORDER: It is hereby ORDERED that: By September 2, 2021, counsel for Stevens shall file any supplemental submission in support of the Petition, or shall confirm in writing that he does not intend to make any such filing. By September 9, 2021, the Government shall file any supplemental opposition to the Petition, or shall confirm in writing that it intends to rely only on the arguments set forth in its March 25, 2021 opposition brief. (See ECF No. 471.) Because Stevens has not at this time made a substantial showing of the denial of a constitutional right, a certificate of appealability will not issue. See 28 U.S.C. 2253. The Court certifies, pursuant to 28 U.S.C. 1915(a)(3), that any appeal from this order would not be taken in good faith. ln forma pauperis status is therefore denied for the purpose of an appeal. CJA counsel on duty today, Benjamin Zeman, will be appointed to advise Stevens in connection with the March 19, 2021 Submission. For the foregoing reasons, it is hereby ORDERED that Lance A. Clarkes motion to withdraw is GRANTED. The Clerk of Court is respectfully directed to terminate the motion at ECF No. 482. Stevenss March 19, 2021 submission is construed as a petition for a writ of habeascorpus pursuant to 28 U.S.C. 2255. (See Apr. 12, 2021 Op. at 6-7). The Clerk of Court is respectfully directed to designate the March 19, 2021 submission (ECF No. 468) as a case brought pursuant to 28 U.S.C. 2255.
