Date Filed Document Text
September 27, 2021 Opinion or Order Filing 6 CIVIL JUDGMENT: IT IS ORDERED, ADJUDGED AND DECREED that this action is dismissed. The Court dismisses Plaintiff's claims under federal law under the doctrines of Eleventh Amendment immunity and judicial immunity, for lack of subject matter jurisdiction under the Rooker-Feldman doctrine, as frivolous, and for failure to state a claim on which relief may be granted. The Court declines to consider, under its supplemental jurisdiction, Plaintiffs claims under state law. See 28 U.S.C. 1367(c)(3). The Court certifies under 28 U.S.C. 1915(a)(3) that any appeal from the Court's judgment would not be taken in good faith. IT IS FURTHER ORDERED that the Clerk of Court mail a copy of this judgment to Plaintiff and note service on the docket. SO ORDERED. (Signed by Judge Laura Taylor Swain on 9/27/21) (Attachments: #1 PRO SE APPEAL PACKAGE) (rdz) Transmission to Docket Assistant Clerk for processing.
September 27, 2021 Opinion or Order Filing 5 ORDER OF DISMISSAL: The Court dismisses this action. The Court declines to consider, under its supplemental jurisdiction, Plaintiff's claims under state law. See 28 U.S.C. 1367(c)(3). The Court certifies under 28 U.S.C. 1915(a)(3) that any appeal from this order would not be taken in good faith, and therefore in forma pauperis status is denied for the purpose of an appeal. See Coppedge v. United States, 369 U.S. 438, 444-45 (1962). The Court directs the Clerk of Court to mail a copy of this order to Plaintiff and note service on the docket. SO ORDERED. September 13, 2021 Filing 4 LETTER from P. Mamot, dated 9/9/21 re: "URGENTLY PRAYING TO CLEAR MY NAME DUE TO ADVANCED AGE & DIRE HEALTH CONDITIONS"- I am constrained to submit this motion due to the fact that I feel my time is up; sooner or later I will die. But it happens, Your Honor, kindly clear my name. My legacy I will give to my grandchildren etc. Kindly request the New York City Board of Education records of supposed "returned check" in the amount of $5,000.00 which Bilinguals through its legal counsel showed to Judge Jeffrey Oing, NYC Small Claims Court without showing me such Xeroxed copy of alleged "returned check(1996-1998). It was enough, to my mind, to dismiss the case. But Judge Oing found me guilty of absconding government funds in the amount of $5,000.00. If there is no Xeroxed record, then it was a rigged decision and should immediately clear my name. Document filed by Patricio R. Mamot.(sc)
