September 7, 2021 Opinion or Order Filing 4 STIPULATION AND ORDER OF SETTLEMENT AND DISMISSAL:IT IS HEREBY STIPULATED AND AGREED, by and between the Parties throughtheir respective counsel, as follows: This action is dismissed without costs, expenses, or attorney's fees as against the United States or ASCAP. This dismissal is without prejudice to the United States' ability to reinstate this action or commence a new action, in accordance with Paragraph 7 below, in the event of a breach of the provisions of this agreement. Following execution by the Parties and entry by the Court of this Stipulation and Order of Settlement and Dismissal (the "Stipulation"), ASCAP shall pay to the United States within fourteen (14) business days of the entry of the Stipulation the sum of seventy-five thousand dollars ($75,000) (the "Upfront Payment") in accordance with instructions to be provided by the United States Attorney's Office for the Southern District of New York. Upon receipt, the Upfront Payment shall be credited against the Levies, in partial satisfaction thereof and further set forth in this Order. (Signed by Judge John P. Cronan on 9/7/2021) (rro)
