ENDORSEMENT: At the last conference, plaintiff's counsel was given one week, until May 25, 2022, to consult with his client as to whether plaintiff would stipulate to defendant's proposed amendment (reserving his right to challenge the merits of the new affirmative defense by motion). The parties were given two and a half weeks, until June 3, 2022, to produce certain documents in advance of their upcoming mediation. (Dkt. No. 28.) Plaintiff did not suggest that he needed the documents to make the amendment decision, and in any event had no reason to expect them prior to May 25. The Court is thus puzzled by plaintiff's attempt to attribute his amendment decision to the fact that he has not yet received the documents. Nonetheless, since plaintiff has declined to stipulate, defendant shall file its motion to amend no later than June 1, 2022. Opposition papers are due no later than June 8, 2022.
