Mailed a copy of #6 Order, to Teddy Moore at 220 West 49th Street, New York, NY 10019. (dsh) |
Filing 6 ORDER: Accordingly, Plaintiff's motion for reconsideration (ECF No. 5) is denied. Plaintiff's case in this Court under Docket No. 21-CV-7805 is closed. The Court will only accept for filing documents that are directed to the United States Court of Appeals for the Second Circuit. If Plaintiff files other documents that are frivolous or meritless, the Court will direct Plaintiff to show cause why he should not be barred from filing further documents in this action. The Court certifies under 28 U.S.C. 1915(a)(3) that any appeal from this order would not be taken in good faith, and therefore IFP status is denied for the purpose of an appeal. Cf. Coppedge v. United States, 369 U.S. 438, 444-45 (1962) (holding that an appellant demonstrates good faith when he seeks review of a nonfrivolous issue). The Clerk of Court is directed to mail a copy of this order to Plaintiff and note service on the docket. SO ORDERED. (Signed by Judge Laura Taylor Swain on 9/27/21) (rdz) Transmission to Docket Assistant Clerk for processing. Transmission to Office of the Clerk of Court for processing. |
Filing 5 LETTER from T. Moore dated 9/27/21 re: "MOTION FOR RECONSIDERATION" - The current case is a proper case of civil rights violation. The Judge in Case # 13-cv-831 has not barred me from filing any new action without obtaining from the Court leave to file such action etc. Thus, I request from your Honor to reconsider your decision and grant me permission to proceed with this case.Document filed by Teddy Moore.(sc) |
Filing 4 CIVIL JUDGMENT: IT IS ORDERED, ADJUDGED, AND DECREED that under the March 8, 2013 order in See Moore v. Bramwell, ECF 1:13-CV-0831, 7 (S.D.N.Y. Mar. 8, 2013), the complaint is dismissed without prejudice. The Court certifies under 28 U.S.C. 1915(a)(3) that any appeal from the Court's judgment would not be taken in good faith. IT IS FURTHER ORDERED that the Clerk of Court mail a copy of this judgment to Plaintiff and note service on the docket. (Signed by Judge Laura Taylor Swain on 9/21/2021) (Attachments: #1 Pro Se Appeal Package) (sac) Transmission to Docket Assistant Clerk for processing. |
Filing 3 ORDER OF DISMISSAL UNDER 28 U.S.C. 1651: On March 8, 2013, Plaintiff was barred from filing any new action in forma pauperis (IFP) without first obtaining from the Court leave to file. See Moore v. Bramwell, ECF 1:13-CV-0831, 7 (S.D.N.Y. Mar. 8, 2013). Plaintiff files this new pro se case, seeks IFP status, and has not sought leave from the Court to file this action. The Court therefore dismisses the action without prejudice because Plaintiff failed to comply with the March 8, 2013 order. The Clerk of Court is directed to mail a copy of this order to Plaintiff and note service on the docket.
