December 7, 2021 Opinion or Order Filing 17 CIVIL CASE MANAGEMENT PLAN AND SCHEDULING ORDER: All parties do not consent to conducting all further proceedings before a United States Magistrate Judge, including motions and trial. See28 U.S.C. 636(c). The deadlines in paragraph 8(b) through 8(f) may be set by the written consent of all parties without application to the Court, provided that all fact discovery is completed by April 8, 2022. This case is to be tried to a jury. Counsel for the parties have conferred and their present best estimate of the length of trial is [5 days]. By February 7, 2022, he parties shall submit a joint status letter, as outlined in Individual Rule IV.A.2. By April 22, 2022, the parties shall submit a joint status letter, as outlined in Individual Rule IV.A.2 and, in the event that they have not already been referred for settlement discussions, shall also advise the Court whether or not they request a referral for settlement discussions as provided in Paragraph 4(c) above. On May 11, 2022 at 4:10 p.m., a pre-motion conference will be held for any anticipated dispositive motions. To join the conference, the parties shall call (888) 363-4749 and use Access Code 558-3333. The Clerk of Court is directed to enter the dates under paragraphs 5, 6, 8(a), 9(b)-(c) and 13(a)-(c) into the Court's calendar. Fact Discovery due by 4/8/2022. December 7, 2021 Opinion or Order Filing 16 ORDER: It is hereby ORDERED that the December 9, 2021, initial pretrial conference is CANCELLED. If the parties believe that a conference would nevertheless be useful, they should inform the Court immediately so the conference can be reinstated. The case management plan and scheduling order will issue in a separate order. The parties' attention is particularly directed to the provisions for periodic status letters, and the need for a pre-motion letter to avoid cancellation of the final conference and setting of a trial date. It is further ORDERED that if Defendants seek to file a motion to dismiss, they shall file a pre-motion letter pursuant to Individual Rules III.A.1 and III.C.2. It is further ORDERED, regarding settlement discussions, if and when the parties are ready to proceed with a settlement conference with the assigned Magistrate Judge or mediation in the Court's mediation program, they shall file a joint letter on ECF requesting a referral.
