CIVIL CASE MANAGEMENT PLAN AND SCHEDULING ORDER: All parties do not consent to conducting all further proceedingsbefore a United States Magistrate Judge, including motions and trial. 28 U.S.C. 636(c). Amended pleadings may not be filed and additional parties may not be joined except withleave of the Court. Any motion to amend or to join additional parties shall be filed no laterthan 1/21/2022. Fact Discovery due by 4/21/2022. All expert discovery, including reports, production of underlyingdocuments, and depositions, shall be completed no later than 4/21/2022. This case is to be tried to a jury. Counsel for the parties have conferred, and the present best estimate of the length of trial is three days. Plaintiff will seek class certification under FRCP 23. Plaintiff proposes that his class certification motion be filed by May 24, 2022; That Defendant shall have until June 23, 2022 to file any opposition; and Plaintiff shall have until July 25, 2022 to file any reply. Pretrial Conference set for 5/3/2022 at 03:30 PM in Courtroom 1105, 40 Centre Street, New York, NY 10007 before Judge Jesse M. Furman. The Court agrees that there is no need for an initial conference, but the parties should note the date of the conference on the previous page. By separate Order to be entered today, the Court is referring this case to the Court-annexed Mediation Program. In the Court's experience, expert discovery and fact discovery can proceed in parallel in cases of this type; accordingly, the Court has changed the deadline for expert discovery to coincide with the deadline for fact discovery.
