The order issued by the Court on January 26, 2022 (Dkt. 34) was a final order to which Bank Audi did not object or file an appeal. Bank Audi does not meet the requirements for Fed. R. Civ. P. 60(b). The purported changed circumstance (withdrawal of a defense) was controlled and created by Bank Audi. Mo reover, the material sought remains of use in the foreign proceeding for the reasons set forth in Petitioner's letter dated March 2, 2022. (Dkt. 38). IT IS FURTHER ORDERED that, prior to serving the Authorized Subpoenas on Respondents and in addition to complying with Federal Rule of Civil Procedure 45(a)(4), Petitioner's counsel will deliver by email a copy of this Order together with the papers on which it is granted to the following counsel for Bank Audi: Andr Nohra of the Cortbaoui & Kanaan Law Firm in Beirut, Lebanon, a t his email address a.nohra@c-klaw.com.
