December 27, 2021 Opinion or Order Filing 58 ORDER: The Court denies Petitioner's motion. First, because Petitioner did not raise this request in the substantial briefing that accompanied its application for discovery, it is an inappropriate basis for a motion for relief from a judgm ent. "A motion for reconsideration is not an 'opportunity for making new arguments that could have been previously advanced,' nor is it a substitute for appeal." Peoples v. Fischer, 898 F. Supp. 2d 618, 624 (S.D.N.Y. 2012) (qu oting Associated Press v. U.S. Dep't of Def., 395 F. Supp. 2d 17, 19 (S.D.N.Y. 2005); R.F.M.A.S., Inc. v. Mimi So, 640 F. November 17, 2021 Opinion or Order Filing 44 ORDER: The Court is in receipt of the Petitioner's motion for relief from the Court's November 4, 2021 order denying discovery under 28 U.S.C. § 1782. Dkt. No. 41. Respondent is hereby ORDERED to file a response on or before Novem ber 24, 2021. Per the Court's order dated November 4, 2021, the parties were to indicate by November 5, 2021, whether either seeks sealing or limited redactions of the Court's Opinion. Dkt. No. 38. Respondent notified the Court that it does not seek redactions, Dkt. No. 40, but the Court is not in receipt of a letter from Petitioner. Accordingly, Petitioner is ORDERED to indicate by November 19, 2021, if it seeks sealing or limited redactions and justify any such request by re ference to the three-part test articulated by the Second Circuit in Lugosch v. Pyramid Co. of Onondaga, 435 F.3d 110, 119-20 (2d Cir. 2006). If the Court does not receive a letter from Petitioner by November 19, 2021, it will file the Opinion without redactions. SO ORDERED. In a Memorandum Opinion & Order temporarily filed under seal, the Court DENIES Petitioner's motio n. The Court will send the temporarily sealed Opinion to the parties. By November 5, 2021, the parties are ORDERED to inform the Court whether either party seeks sealing or limited redactions of the Court's Opinion, justifying any such requ est by reference to the three-part test articulated by the Second Circuit in Lugosch v. Pyramid Co. of Onandaga, 435 F.3d 110, 119-20 (2d Cir. 2006). In addition, both parties filed redacted copies of their underlying briefing without making specific application to the Court.
