Filing 46 MEMO ENDORSEMENT on re: #45 Letter filed by Jane Doe 1. ENDORSEMENT: Application denied. SO ORDERED. (Signed by Judge Gregory H. Woods on 8/9/2022) (rro) |
Filing 45 LETTER addressed to Judge Gregory H. Woods from Jeanne Christensen dated August 8, 2022 re: Objections to the Report and Recommendation. Document filed by Jane Doe 1..(Christensen, Jeanne-Marie) |
Filing 44 REPORT & RECOMMENDATION re: #16 MOTION to Dismiss Complaint, MOTION to Change Venue to the District of Massachusetts, filed by McAdam Financial Group LLC, #24 MOTION to Dismiss for Lack of Jurisdiction to Change Venue or Otherwise Dismiss, filed by Charles Norfleet. The Court lacks personal jurisdiction over the Defendants or, at a minimum, personal jurisdiction is a difficult question. Because venue is proper in the District of Massachusetts and the interests of justice favor transferring this case to that District, I recommend that the Court transfer the case to the District of Massachusetts. Should the Court disagree with this recommendation, I request that the Court remand the matter to me for consideration of Defendants' alternative Rule 12(b)(6) arguments. The parties shall have fourteen days from the service of this Report and Recommendation to file written objections pursuant to 28 U.S.C. 636(b)(1) and Rule 72(b) of the Federal Rules of Civil Procedure. A party may respond to another party's objections within fourteen days after being served with a copy. Fed. R. Civ. P. 72(b)(2). Such objections shall be filed with the Clerk of the Court, with courtesy copies delivered to the chambers of the Honorable Gregory H. Woods at the United States Courthouse, 500 Pearl Street, New York, New York 10007, and to any opposing parties. See 28 U.S.C. 636(b)(1); Fed. R. Civ. P. 6(a), 6(d), 72(b). Any requests for an extension of time for filing objections must be addressed to Judge Woods. The failure to file these timely objections will result in a waiver of those objections for purposes of appeal. See 28 U.S.C. 636(b)(1); Fed. R. Civ. P. 6(a), 6(d), 72(b); Thomas v. Arn, 474 U.S. 140 (1985). (Objections to R&R due by 8/17/2022.) (Signed by Magistrate Judge Sarah Netburn on 8/3/2022) (ras) |
