Filing 7 AMENDED MOTION(APPLICATION) TO PROCEED WITHOUT PREPAYING FEES OR COSTS(ON APPEAL). Document filed by Courtney Green.(sc) |
Filing 6 CIVIL JUDGMENT: IT IS ORDERED, ADJUDGED AND DECREED that the complaint is dismissed without prejudice for Plaintiff's failure to submit a completed amended request to proceed in forma pauperis or pay the $402.00 in filing fees. See 28 U.S.C. 1914, 1915. The Court certifies under 28 U.S.C. 1915(a)(3) that any appeal from the Court's judgment would not be taken in good faith. IT IS FURTHER ORDERED that the Clerk of Court transmit a copy of this judgment to Plaintiff. SO ORDERED. (Signed by Judge Laura Taylor Swain on 2/25/22) (Attachments: #1 PRO SE APPEAL PACKAGE) (rdz) Transmission to Docket Assistant Clerk for processing. |
Filing 5 ORDER OF DISMISSAL: By order dated January 13, 2022, the Court directed Plaintiff, within thirty days, to submit a completed amended request to proceed in forma pauperis ("IFP application") or pay the $402.00 in fees required to file a civil action in this court. That order specified that failure to comply would result in dismissal of the complaint. Plaintiff has not filed an amended IFP application or paid the fees. Accordingly, the complaint is dismissed without prejudice. See 28 U.S.C. 1914, 1915. The Court certifies under 28 U.S.C. 1915(a)(3) that any appeal from this order would not be taken in good faith, and therefore IFP status is denied for the purpose of an appeal. Cf. Coppedge v. United States, 369 U.S. 438, 444-45 (1962) (holding that an appellant demonstrates good faith when he seeks review of a nonfrivolous issue). Filing 4 ORDER DIRECTING PAYMENT OF FEES OR AMENDED IFP APPLICATION: Plaintiff is directed to render payment of the filing fees or submit an AMENDED IFP application to this Court's Pro Se Office within thirty (30) days of the date of this Order. The Clerk of Court is directed to assign this matter to my docket. The Court certifies, pursuant to 28 U.S.C. 1915(a)(3), that any appeal from this Order would not be taken in good faith, and therefore in forma pauperis status is denied for the purpose of an appeal. See Coppedge v. United States, 369 U.S. 438, 444-45 (1962). Filing Fees due by 2/14/2022. AMENDED In Forma Pauperis (IFP) Application due by 2/14/2022.
