February 4, 2022 Opinion or Order Filing 4 STIPULATION AND ORDER OF SETTLEMENT: NOW, THEREFORE, IT IS HEREBY STIPULATED, AGREED AND ORDERED, by and between the United States, by and through its attorneys Damian Williams, United States Attorney for the Southern District of New York, and Assistant United States Attorneys Emily Deininger and Sheb Swett, of counsel, and Private Label PC, LLC, by and through its attorneys Samidh Guha and Brian A. Sun, that: Private Label hereby consents to the forfeiture to the United States of the Defendants -in-rem. Upon the entry of this Stipulation and Order. the United States will instruct the United States Marshals Service ("USMS") to release the remainder of the Seized Funds (the "Remaining Funds") from the custody of the USMS pursuant to instructions provided by Private Label on a Unified Financial Management System Vendor Request Form. Upon entry of a Judgment of Forfeiture forfeiting the Defendants-in-rem to the United States, the United States shall not bring any civil forfeiture action against or otherwise seek to forfeit any other property owned by Private Label based on any and all transactions described in the Forfeiture Complaint or the affidavit submitted in support of the Seizure Warrants. This Stipulation and Order constitutes the entire agreement between the Parties on the matters raised herein, and no other statement promise or agreement either written or oral made by any party or agents of any party, that is not contained in this written Stipulation and Order shall be enforceable.
