April 8, 2022 Opinion or Order Filing 19 ORDER: The plaintiff, who is proceeding prose, paid the filing fees to commence this action. Accordingly, he is not entitled to rely on the U.S. Marshals Service to effect service on the defendants under Federal Rule of Civil Procedure 4(c)(3). In his letter dated April 4, 2022, the plaintiff indicates that he brought this action against the "first three defendants" - that is, Merrick B. Garland, Letitia James, Kilolo Kijakazi and the New York City Corporation Counsel in their official capacities. See ECF No. 18. The plaintiff is advised that Merrick B. Garland and Kilolo Kijakazi, to the extent they are being sued in their official capacities, must be served in accordance with Federal Rule of Civil Procedure 4(i)(2). That Rule provides that, "[t]o serve a United States officer or employee sued only in an official capacity, a party must serve the United States and also send a copy of the summons and of the complaint by registered or certified mail to the agency, corporation, officer, or employee." Letitia James may be served at the Office of the Attorney General in either Albany or New York City. The New York City Corporation Counsel may be served at the Corporation Counsel's office. February 4, 2022 Opinion or Order Filing 4 ORDER: The Court finds that that the plaintiff's submission is a civil action not a habeas corpus petition. If the plaintiff does not want to pursue relief in a civil action, he may notify the Court in writing within 30 days that he wishes to withdraw the complaint. The Clerk of Court is directed to refund the plaintiff the $402.00 in filing fees for this action if he withdraws the action. If the plaintiff does not inform the Court of his intent within 30 days, this action will proceed as a civil complaint. In accordance with this Order, the Clerk of Court is directed to designate this matter on the docket as a civil complaint brought under 28 U.S.C. 1331. The Court certifies under 28 U.S.C. 1915(a)(3) that any appeal from this Order would not be taken in good faith, and therefore in forma pauperis status is denied for the purpose of an appeal. Cf.
