STIPULATION OF SETTLEMENT, GENERAL RELEASE AND ORDER OF DISMISSAL: NOW, THEREFORE, in consideration of the mutual promises, covenants, representations, and other consideration contained in this Stipulation, Plaintiffs and Defendants hereby stipulate and agree, and the Court orders, as follows: Dismissal of the Action; All claims constituting the Action and the Complaint itself is dismissed with prejudice as against are hereby dismissed, with prejudice, and without payments, attorneys' fees, costs, disbursements, or expenses, Acts to be Taken by Defendants: Defendants agree to undertake the following: As of February 4, 2022, Defendants removed the Firshein's name, image and biographical statement as well as The Firshein Centers name and logo from all web sites, advertisement, brochures, or other information disseminated to the public or to any governmental agencies all logos or identifiers of the Firshein Center. In furtherance thereof, Defendants collectively agree that in the event additional actions are required to further remove content and disassociate Firshein and the Firshein Center from any impression of business association with any Defendants or any endorsement of Defendants or their products or services, that Defendants will take all steps necessary to do so.
