Filing 8 ORDER: Osias's claims against the New York City Department of Correction ("DOC") must be dismissed. As an agency of the City of New York, the DOC lacks the capacity to be sued in its own name and must instead be sued in the name of the City of New York. The Clerk of Court is respectfully directed to electronically notify the New York City Department of Correction and the New York City Law Department of this Order. The Court requests that the remaining defendants waive service of summons. The Clerk of Court is also respectfully directed to mail a copy of this Order to Osias, together with an information package. The Court certifies under 28 U.S.C. 1915(a)(3) that any appeal from this Order would not be taken in good faith, and therefore in forma pauperis status is denied for the purpose of an appeal. Cf Coppedge v. United States, 369 U.S. 438, 444--45 (1962) (holding that an appellant demonstrates good faith when he seeks review of a nonfrivolous issue). SO ORDERED.
