Filing 9 ORDER: This case has been assigned to me for all purposes. The parties should abide by this Court's Special Rules of Practice in Civil Pro Se Cases, which are attached to this Order. This case has been assigned to me for all purposes. It is hereby ORDERED that a conference will be held on April 27, 2022 at 4:30 p.m. The conference will be telephonic. Plaintiff, who is currently incarcerated, is proceeding pro se (without an attorney). For parties represented by counsel, all pretrial conferences must be attended by the attorney who will serve as principal trial counsel. The parties shall ensure they are all dialed into the conference call by the appointed conference time. By the date of the initial pretrial conference, counsel for any represented party is required to register as a filing user on ECF. IT IS HEREBY ORDERED that the Warden or other official in charge of the Vernon C. Bain Center in Bronx, NY, or other facility in custody of Ruddy Osias, produce inmate Ruddy Osias, NYSID: 00016464N, to an office in the facility with a reasonable degree of privacy to enable him to participate in a court conference through means of a teleconference from the facility to the United States Courthouse, Southern District of New York, on April 27, 2022, commencing at 4:30 p.m. until completion. At the date and time set forth herein, counsel for the defendants shall place the call to the facility and, with all parties on the line, dial in to a teleconference number provided in an order issued by the Court at least 24 hours prior to the conference date. If this time and date presents an inconvenience, the Warden or the Warden's designee should promptly inform Chambers by calling (212) 805-0288. As further set forth in this Order. Filing 7 ORDER OF SERVICE: The Court dismisses Plaintiff's claims against "Department of Corrections, City of New York," and respectfully directs the Clerk of Court to add the City of New York as a defendant in this action. See Fed. R. Civ. P. 21. The Court also respectfully directs the Clerk of Court to notify the New York City Department of Correction and the New York City Law Department of this order. The Court requests that the City of New York, former DOC Commissioner Vincent Schiraldi, VCBC Correction Captain Reyez, VCBC Correction Captain Hamlet, and VCBC Warden Carter waive service of summons. The Court certifies under 28 U.S.C. 1915(a)(3) that any appeal from this order would not be taken in good faith, and therefore IFP status is denied for the purpose of an appeal. Cf. Coppedge v. United States, 369 U.S. 438, 444-45 (1962) (holding that an appellant demonstrates good faith when he seeks review of a nonfrivolous issue). That agency is directed to forward copies of Plaintiff's prison trust fund account statements for the past six months and to disburse the payments required under 28 U.S.C. 1915 to the United States District Court for the Southern District of New York and to include the above docket number on the disbursement before sending it to the court. Filing 2 ORDER: The Court severs from this action, under Rule 21 of the Federal Rules of Civil Procedure, the claims of Plaintiffs Guest, Caraballo, and Agnew. Plaintiff Osias will proceed as the sole plaintiff in this action, and he is directed, within 30 days, to either pay the $402 in fees to bring this action or complete, sign, and return the attached IFP application and prisoner authorization under this action's docket number, 1:22-CV-0870 (LTS). No summons shall issue at this time. If Plaintiff Osias complies with this order, this action shall be processed in accordance with the procedures of the Clerks Office. If Plaintiff Osias fails to comply with this order within the time allowed, the Court will dismiss this action. The Court directs the Clerk of Court to open three new separate civil actions with three new docket numbers for the claims of Plaintiffs Guest, Caraballo, and Agnew, and docket in each of those actions a copy of the complaint and this order. Once each new action is opened, the Court will issue orders directing Plaintiffs Guest, Caraballo, and Agnew to each either pay the fees to bring a separate action or complete, sign, and return an IFP application and prisoner authorization. The Court also directs the Clerk of Court to mail copies of this order to Plaintiffs Osias, Guest, Caraballo, and Agnew, and note service on the docket. SO ORDERED.
