Mailed a copy of #3 Order, to Lawrence Chan, P.O. 844321, Brooklyn, NY 11203. (dsh) |
Received returned mail re: #3 Order. Mail was addressed to Lawrence Chan, P.O. Box 886463, Brooklyn, NY 11209 and was returned for the following reason(s): Return To Sender Attempted - Not Known Unable To Forward. (vn) |
Filing 3 ORDER DIRECTING PAYMENT OF FEES: No summons shall issue at this time. The Court directs Plaintiff, within thirty days of the date of this order, to pay the $402.00 in fees by using one of the acceptable forms of payment noted above. If Plaintiff fails to comply with this order within the time allowed, the action will be dismissed. The Cashiers Unit is directed to return the $402.00 personal check to Plaintiff at the address indicated on Plaintiff's complaint. The Court certifies under 28 U.S.C. 1915(a)(3) that any appeal from this order would not be taken in good faith, and therefore IFP status is denied for the purpose of an appeal. Cf. Coppedge v. United States, 369 U.S. 438, 444-45 (1962) (holding that appellant demonstrates good faith when seeking review of a nonfrivolous issue). The Clerk of Court is directed to mail a copy of this order to Plaintiff and note service on the docket. SO ORDERED. (Signed by Judge Andrew L. Carter, Jr on 2/07/2022) (ama) Transmission to Docket Assistant Clerk for processing. Transmission to Finance Unit (Cashiers) for processing. Modified on 2/9/2022 (ama). |
