March 23, 2022 Opinion or Order Filing 12 SCHEDULING ORDER: After reviewing the parties' proposed schedule in this case, the Court adopts the following scheduling order pursuant to Rule 16 of the Federal Rules of Civil Procedure: 1. Initial disclosures shall be made by April 6, 2022. The parties may move to amend the pleadings or join any other parties no later than April 21, 2022. 2. All requests for documents and interrogatories pursuant to Local Civil Rule 33.3(a) shall be served by April 22, 2022. 3. All non-expert discovery shall be commenced in time to be completed by July 21, 2022. 4. Disclosure of expert evidence as required by Rule 26(a)(2)(A), (B) or (C), including the identities and reports of experts, if any, will be made by September 2, 2022. 5. The disclosure of expert evidence intended by a party solely to contradict or rebut expert evidence on the same subject matter disclosed by the opposing party shall be made by September 19, 2022. 6. Depositions of experts shall be completed by October 3, 2022. 7. The parties shall inform each other in writing by October 3, 2022 whether either intends to file a summary judgment motion. 8. Any summary judgment motion shall be filed by October 24, 2022. 9. If no party states its intention to file a summary judgment motion, the parties shall file the pre-trial order materials required by the District Judge's Individual Practices by October 24, 2022. If, however, a summary judgment motion is filed on or before the date in the previous paragraph, the due date of the pretrial order materials shall be extended to 30 days following decision on the summary judgment motion. 10. The parties shall file a letter on ECF as soon as both sides are prepared to proceed with a mediation and the Court will issue an order scheduling this matter for the Court's mediation program. 11. All discovery (including requests for admission and any applications to the Court with respect to the conduct of discovery) must be initiated in time to be concluded by the deadline for all discovery. Any application for an extension of the time limitations herein must be made as soon as the cause for the extension becomes known to the party making the application and in accordance with this Court's Individual Practices. Any application not in compliance with this paragraph will be denied. To the extent a party expects to produce electronically stored information, the parties shall promptly discuss the protocols for the search and review of such material. 12. All applications to the Court must comply with this Court's Individual Practices, which are available through the Clerk's Office or at, as further set forth in this Order. SO ORDERED.
