April 6, 2022 Opinion or Order Filing 7 ORDER: By order dated March 14, 2022, the Court dismissed this action for failure to state a claim on which relief may be granted, but granted Plaintiff, who appears pro se, 30 days' leave to replead his claims of mail tampering under 42 U.S.C. 1983 against Defendants Iccari and/or Story in an amended complaint. On April 5, 2022, the Court received a letter from Plaintiff in which he requests an extension of time, until May 16, 2022, to comply with the Court's March 14, 2022 order. (ECF 6.) The Court grants Plaintiff's request. The period in which Plaintiff has leave to file an amended complaint, in compliance with the Courts March 14, 2022 order, is extended to May 16, 2022. If Plaintiff fails to file an amended complaint within the time allowed, the Court will enter judgment dismissing this action for the reasons set forth in the Court's March 14, 2022 order. March 14, 2022 Opinion or Order Filing 5 ORDER OF DISMISSAL: The Court dismisses Plaintiff's claims under Section 1983 against the defendants arising from their failure to release Plaintiff from incarceration on his conditional-release date without prejudice to Plaintiff's reasserting such claims after Plaintiff has been granted habeas corpus relief, or other relief, which would invalidate his incarceration after his conditional-release date. The Court grants Plaintiff leave to replead his claims of mail tampering under Section 1983 against Defendants Iccari and/or Story in amended complaint, which must be filed within 30 days of the date of this order. If Plaintiff fails to file an amended complaint within the time allowed, the Court will enter judgment dismissing this action for the reasons set forth in this order. The Court certifies under 28 U.S.C. 1915(a)(3) that any appeal from this order would not be taken in good faith, and therefore IFP status is denied for the purpose of an appeal. See Coppedge v. United States, 369 U.S. 438, 444-45 (1962). The Court directs the Clerk of Court mail a copy of this order to Plaintiff and note service on the docket. February 28, 2022 Opinion or Order Filing 4 ORDER GRANTING IFP APPLICATION IN PRISONER CASE: The Clerk of Court is directed to send a copy of this order and the prisoner authorization to the agency having custody of Plaintiff. That agency is directed to forward copies of Plaintiff's prison trust fund account statements for the past six months and to disburse the payments required under 28 U.S.C. 1915 to the United States District Court for the Southern District of New York and to include the above docket number on the disbursement before sending it to the court. If Plaintiff is transferred to another facility, the current facility shall provide a copy of this order to the facility to which he is transferred. The Clerk of Court is also directed to send a copy of this order to Plaintiff and note service on the docket. Finally, it is Plaintiff's obligation to promptly submit a written notification to the court if his address changes, and the court may dismiss the action if he fails to do so.
