STIPULATION AND ORDER: NOW, THEREFORE, IT IS HEREBY STIPULATED AND AGREED by and among the undersigned counsel for the parties herein that: Defendants' time to file letters requesting a pre-motion conference for motions to dismiss or otherwise respond to the operative complaint in this action is extended to the later of: a. 45 days after Plaintiff files a consolidated and amended complaint; or b. 45 days after Plaintiff informs Defendants in writing that they do not plan to file a consolidated and amended complaint. Notwithstanding the foregoing, if Defendants' deadline to file letters requesting a premotion conference for motions to dismiss or otherwise respond to the operative complaint in the Dinosaur Financial Action, or any subsequently filed action that is related to this Action, is earlier than the deadline provided for in Paragraph 1 above, then Defendants' deadline in Paragraph 1 shall be the same date as the earlier of such deadline in the Dinosaur Financial Action or any subsequently filed related action; If Defendants are permitted to file a motion to dismiss, the parties will meet and confer and jointly propose a briefing schedule to the Court for the motion to dismiss. Defendants, however, agree to provide Plaintiff at least 45 days to respond to such motion; and. This Stipulation may be signed in counterparts, and facsimile or scanned copies shall be treated as originals for all purposes.
