May 20, 2022 Opinion or Order Filing 12 STIPULATION AND ORDER, IT IS HEREBY STIPULATED AND AGREED by and between the undersigned counsel to Hyper and Acctel as follows: 1. The Hyper Action and the Acctel Action are hereby consolidated, and the caption is hereby amended as set forth above. By this Order, the Court directs the Clerk of Court to take all necessary steps to consolidate these matters into a single action for purposes of electronic filing and for all other purposes. 2. Hyper hereby acknowledges service of process of the Summons and Complaint in the Acctel Action. Acctel, which has not yet been served, hereby accepts service of process of the Summons and Complaint in the Hyper Action. All defenses, other than service of process, are explicitly preserved. 3. Both Hyper and Acctel shall answer or otherwise move with respect to the complaint filed against it on or before August 2, 2022. Any opposition shall be due on or before September 2, 2022, and any reply shall be due on September 16, 2022. 4. Defendant Tapesh Sinha is not a party to this stipulation in any respect. 5.
