ORDER REMANDING CASE denying #4 Letter Motion for Extension of Time. On May 13, 2022, the Court ordered Defendant to show cause by May 20, 2022 why this case should not be remanded for lack of subject matter jurisdiction. [ECF No. 3]. Defendant has asked for an extension of the time to respond to the Court's order because the parties are attempting to finalize a settlement. [ECF No. 4]. However, the Court will not retain an action on its docket over which it does not have subject matter jurisdiction. Accordingly, IT IS HEREBY ORDERED that Defendant's request for an extension to respond to the Order to Show Cause [ECF No. 4] is DENIED and this case is REMANDED for lack of federal subject matter jurisdiction. The Clerk of the Court respectfully is requested to remand this case to New York Supreme Court for further proceedings. SO ORDERED.
