Defendant has asked for an extension of the time to respond to the Court's order because the parties are attempting to finalize a settlement. [ECF No. 4]. However, the Court will not retain an action on its docket over which it does not have subject matter jurisdiction. Accordingly, IT IS HEREBY ORDERED that Defendant's request for an extension to respond to the Order to Show Cause [ECF No. 4] is DENIED and this case is REMANDED for lack of federal subject matter jurisdiction.
