Filing 6 DECLARATION of Nicole Lawtone-Bowles(Jurisdiction & Venue), in Response to re: #5 Order 30 Days Other (case opening). Document filed by Nicole Lawtone-Bowles. (sc) |
Filing 5 ORDER: The Court directs Plaintiff to show cause by declaration, within 30 days of the date of this order, why the Court should not transfer this action to the United States District Court for the Western District of Virginia under 28 U.S.C. 1404(a). A declaration form is attached to this order. If Plaintiff fails to file a declaration within the time allowed, or fails to show adequate cause why the Court should not direct the transfer of this action, the Court will transfer this action to the Western District of Virginia under Section 1404(a). Plaintiff has filed with her complaint a motion for permission for electronic case filing. (ECF 3.) Because Plaintiff has not provided all of the information required by that motion form, the Court denies that motion without prejudice to Plaintiffs filing another such motion form that is completed. The Court certifies, pursuant to 28 U.S.C. 1915(a)(3), that any appeal from this order would not be taken in good faith, and therefore IFP status is denied for the purpose of an appeal. See Coppedge v. United States, 369 U.S. 438, 444-45 (1962). SO ORDERED. (Signed by Judge Laura Taylor Swain on 8/22/22) (Attachments: #1 Declaration Form) (rdz) |
