Appellant also moves to seal certain exhibits and redact certain personal information in the filings. Appellee does not oppose the motion to seal. Upon due consideration, it is hereby ORDERED that the motion for a stay of return pending appeal is GRANTED. See In re World Trade Ctr. Disaster Site Litig., 503 F.3d 167, 170 (2d Cir. 2007). We are aware that the Supreme Court generally disfavors the granting of stays in the context of Hague Convention litigation, and that "the Hague Convention... stress[es] the importance of the prompt return of children wrongfully removed or retained." Chafin v. Chafin, 568 U.S. 165, 178 (2013). We note, however, that this is an unusual case insofar as it does not appear to involve a request for family reunification and also insofar as it potentially raises difficult questions under the law of the United Kingdom concerning custody, the answers to which are not apparent on the record presently before the panel. Appellant, pro se and fee paid, moves for appointment of pro bono counsel and for a stay of the district court's return order under the Hague Convention on the Civil Aspects of International Child Abduction (the "Hague Convention"). Appellee opposes the motion and cross moves to expedite the appeal. Upon due consideration, it is hereby ORDERED that the motion for appointment of counsel is GRANTED. See 28 U.S.C. 1915(e)(1); Cooper v. A. Sargenti Co., 877 F.2d 170, 17274 (2d Cir. 1989) (per curiam). Counsel shall be appointed from the pro bono panel and shall represent the Appellant through this Court's determination of the merits. Appointed counsel shall brief, among any other issues supported by the record, whether: (1) the district court erred by holding that Baby L was a habitual resident of the United Kingdom at the time of Baby L's removal from the United Kingdom; (2) the district court erred by holding that the Appellee had rights of custody over Baby L at the time of Baby L's removal from the United Kingdom; and (3) the district court erred by holding that Appellant had failed to establish, with clear and convincing evidence, an affirmative defense under Article 13(b) of the Hague Convention.It is further ORDERED that the motion for a stay of return pending appeal is DENIED without prejudice to renewal upon compliance with Fed. R. App. P. 8(a). See Agudath Isr. of Am. v. Cuomo, 980 F.3d 222, 225 (2d Cir. 2020) (per curiam) (denying an injunction pending appeal where the movants did not first move for an injunction pending appeal in the district court and did not justify that failure). Nevertheless, it is further ORDERED sua sponte that the return order shall be temporarily stayed for 60 days following the entry of this order. See Fed. R. App. P. 2 (providing that the Court may suspend any provision of the Federal Rules of Appellate Procedure in a particular case "to expedite its decision or for other good cause" shown). The purpose of the stay is to provide the Court with time to locate and appoint pro bono counsel, to provide pro bono counsel reasonable time to comply with Rule 8(a) and to prepare a stay motion, and for the district court and this Court to consider that presumed renewed motion for a stay pending appeal. It is further ORDERED that Appellee's cross-motion to expedite the appeal is GRANTED. See Fed. R. App. P. 2. After pro bono counsel is appointed, the Clerk of Court is directed to enter an expedited schedule for merits briefing, in consultation with counsel for both parties, and to calendar this appeal for the first available panel after the appeal is fully briefed.
