The acts or omissions that allegedly took place occurred at the Otisville Correctional Facility, located in Otisville, New York and at the Woodbourne Correctional Facility, located in Sullivan County, New York and Plaintiff names David Howard, the Superintendent of Woodbourne Correctional Facility as a Defendant. Accordingly, transfer of this action is appropriate. See 28 U.S.C. 1406( a) (if an action is filed in the wrong district court, a court "shall dismiss, or if it be in the interest of justice, transfer such case to any district or division in which it could have been brought."). The Clerk of Court is hereby directed to transfer this action to the United States District Court for the Southern District of New York. 28 U.S.C. 139l(b); 1406(a).
